Tavla & Dama Terms of Service

1. Agreement

These Terms of Service (the “Terms”) apply to Tavla & Dama (the “Game”), a collection of classic board games published by Mali's Games (“Mali's Games”, “we”, “us”, “our”), an independent game studio. By downloading, installing or playing the Game you agree to these Terms. If you do not agree, please do not use the Game.

The Game is distributed through Apple’s App Store and Google Play. The terms of the store you downloaded it from (for Apple, the Apple Media Services Terms and Conditions; for Google, the Google Play Terms of Service) also apply. If those store terms give you more rights than these Terms, the store terms apply to that extent.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be changed by agreement, including the laws of the European Union, the United Kingdom and your country of residence.

2. Your licence to use the Game

We give you a personal, non-exclusive, non-transferable, revocable licence to download, install and play the Game on devices you own or control, for your own non-commercial entertainment, in line with these Terms and the rules of the store you downloaded it from.

The Game is licensed to you, not sold. Mali's Games and its licensors keep all rights in the Game that are not expressly granted to you.

3. A free game supported by ads

The Game is free to download and play. It is supported by advertising: interstitial ads after a finished game or match and optional rewarded video ads. Ads are delivered by third-party ad networks through Unity LevelPlay. We do not control the content of individual ads; if you see an ad that you think is inappropriate, please tell us at support@malisgames.com.

Rewarded video ads are always optional. A reward is given only when the ad network confirms that the video was completed, and an ad may not always be available. Your advertising and tracking choices are explained in the Tavla & Dama Privacy Policy.

4. In-app purchases

The Game offers optional in-app purchases, such as Remove Ads and packs of boards and checkers. The Game can be fully played without buying anything.

• Payment: all purchases are made through and paid to Apple or Google, at the price shown in the store at the time of purchase. We never receive your payment card or bank details.
• What you get: each purchase gives you a licence to use the purchased item or feature in the Game, as described in the store. Items have no cash value and cannot be exchanged for money, transferred or sold.
• Remove Ads: removes interstitial ads. Optional rewarded videos stay available if you choose to watch them.
• Trials: where the Game lets you try a cosmetic item for a limited time (for example after watching a rewarded video), the item is available only until the trial ends.
• Restoring purchases: purchases are linked to your Apple or Google account. If you reinstall the Game or change device, use Restore purchases in the Game with the same store account.
• Refunds: because payments are processed by Apple or Google, refund requests are handled by them under their policies. Apple: reportaproblem.apple.com. Google Play: Google Play refund policy. If a purchased item does not work, contact us and we will help.
• Digital content in the EU and UK: purchased items are delivered immediately. When you buy, the store asks you to agree to immediate delivery, and you acknowledge that you therefore lose the statutory right of withdrawal, as permitted by law. Your other legal rights, for example if an item is faulty, are not affected.

5. Friend rooms and conduct

Friend rooms let you play online with people you invite using a room code. They are optional. When you use them:

• Choose a nickname that is not offensive, hateful, sexual, misleading or someone else’s name or trademark.
• Communication is limited to emojis and set phrases; do not use them to harass other players.
• Do not cheat, use modified versions of the Game, or try to disrupt rooms or the online service.

Online play depends on your internet connection and on Unity Gaming Services. A game may end if a player disconnects, and rooms may occasionally be unavailable. Friend rooms do not involve stakes, prizes or rankings of any kind.

6. Game data and progress

The Game has no accounts or cloud saves. Your progress, settings and statistics are stored only on your device. If you uninstall the Game, clear its data or change device, this information may be lost and we cannot recover it. Purchases can be restored as described above.

7. Acceptable use

When using the Game, you agree not to:

• copy, modify, distribute, sell, rent or sublicense the Game or any part of it;
• reverse engineer, decompile or disassemble the Game, except where the law expressly allows this;
• use cheats, bots, exploits or unauthorised software, or interfere with ads, purchases or other players;
• use the Game for any unlawful purpose or in a way that breaches these Terms.

8. Intellectual property

The Game, including its code, design, levels, artwork, sounds, text and the names Tavla & Dama and Mali's Games, belongs to Mali's Games or its licensors and is protected by intellectual property laws. Third-party components are used under their own licences.

The rules of traditional games such as the card and board games in Tavla & Dama are not owned by anyone; our implementation of them is.

9. Updates and availability

We may update the Game to fix problems, add or change features, or meet legal or store requirements. Some updates may be required to keep playing. We may also stop offering the Game or parts of it. Where the law requires it, we will give you reasonable notice of significant changes.

The Game needs a compatible device and operating system. Some features, such as ads and online play, need an internet connection.

10. Disclaimer

We work to make the Game enjoyable and reliable, but it is provided “as is” and “as available”. To the extent permitted by law, we do not promise that the Game will be uninterrupted, error-free or meet every expectation. This does not affect any statutory rights you have as a consumer, including your rights if digital content is faulty.

11. Limitation of liability

To the extent permitted by law, Mali's Games is not liable for indirect or consequential loss, or for loss of data stored on your device, arising from your use of the Game. Where liability can be limited, our total liability to you is limited to the amount you paid for in-app purchases in the Game in the 12 months before the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

12. Ending these Terms

You can stop using the Game at any time by uninstalling it. We may suspend or end your licence if you seriously or repeatedly breach these Terms. Sections that by their nature should continue (such as intellectual property, disclaimer and limitation of liability) continue after these Terms end.

13. Apple and Google

These Terms are between you and Mali's Games only, not with Apple or Google. Mali's Games, not Apple or Google, is responsible for the Game and its content, maintenance, support and any claims relating to it (including product liability, legal or regulatory compliance and intellectual property claims).

If you downloaded the Game from the App Store: Apple has no obligation to provide maintenance or support for the Game. If the Game fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the Game. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence, and you may bring a claim in the courts of that country.

Before starting any formal dispute, please contact us so we can try to resolve the issue informally. Consumers in the EU can also use the dispute resolution bodies available in their country.

15. Changes to these Terms

We may update these Terms, for example when the Game or the law changes. The “Last updated” date at the top of this page shows the latest version. If a change is significant, we will take reasonable steps to let you know, for example through a notice in the Game or on this page. If you keep playing after a change takes effect, the updated Terms apply.
